A Last Will & Testament is a legal document that provides instructions to the probate court on how you would like your assets to be distributed upon your death. As part of your Last Will & Testament, you nominate a Personal Representative (Executor) of your estate, who is in charge of taking care of the entire probate process. The Personal Representative, in conjunction with a probate attorney, will take an inventory of your probate assets, settle any valid outstanding debts and will make any necessary property distributions. Your Last Will & Testament also plays another crucial role; it nominates a guardian for your minor children in the event that you (and your spouse) would become incapacitated or pass away.
